§ 1 Scope of Application

These general terms and conditions govern the business relationship between Quotus Publishing UG (haftungsbeschränkt) (hereinafter Vendor) and the Buyer. The applicable version is the one valid at the time of the order. Different conditions will not be accepted by the Vendor, unless expressly agreed in writing.

§ 2 Conclusion of contract

Your order will be placed once you add a product to the cart and click the button labeled "Order". By placing an order you declare a binding intent to purchase the respective product. Receipt of your order will be promptly confirmed by e-mail. This confirmation is an automatic process and does not constitute a legally binding acceptance on our behalf of your order. The contract arises, when we deliver the product ordered by you.

§ 3 Right of Withdrawal

Information about the right of Withdrawal for orders of printed publications and other physical goods:

Consumers are entitled to a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for a purpose that can not be attributed to a commercial activity (§ 13 BGB).

Information about the right of withdrawal
You have the right to cancel the contract within fourteen days without giving any reason.
The revocation period is fourteen days, and it commences when you or a third party named by you, other than the carrier, take(s) physical possession of the goods.
To exercise your right of withdrawal, you need to notify us by means of a clear statement (sent e.g. by post mail, fax or email) about your decision to withdraw from this contract. You may use the withdrawal form attached below, which is however not mandatory.

In order to comply with the deadline for withdrawal, it is sufficient for you to send the notice before end of the deadline.

Effects of withdrawal
If you withdraw from the contract, we have to reimburse you for all payments that we have received from you, including delivery costs (with the exception of any additional costs should you have chosen a type of delivery other than offered by us). Repayment has to be executed immediately – at latest within fourteen days after the date on which we received your notification. For this repayment, we will use the same method of payment that you used in the original transaction, unless explicitly agreed otherwise between us. In any case you will not be charged any fees for the repayment.
We may withhold the reimbursement until we have received back the goods, or until you have demonstrated that you have returned the goods, whichever is the earlier.
You have to return the goods promptly and in any case not later than fourteen days after you notified us of the cancellation. You comply with the deadline if you send the goods before end of the fourteen days. You shall bear the direct costs of returning the goods.
For any diminished value you will only need to compensate us, if the loss of value is due to an un-necessary handling, which is contrary to the nature of the good, and not necessary to ascertain the characteristics and functioning of the goods.

Exclusion or early termination of the right of withdrawal:

A right of Withdrawal does not apply to goods that are not prefabricated and which are manufactured based on individual choice or decisions by the consumer is important or which are clearly tailored to the personal needs of the consumer.

A right of withdrawal is not applicable for contracts about the delivery of journals.
The right of revocation expires for contracts about services, as soon as the Vendor has completed his service, and if he had started executing his contractual obligation only after the consumer has given his express consent and confirmed at the same time his understanding that his right of withdrawal will terminate after full performance of Vendor’s obligation (e.g. download of electronic files, download of electronic articles or chapters).

§ 4 Reservation of unavailability

We reserve the right to refrain from carrying out your order when the product is out-of-stock and the ordered goods are not available for that reason. In this case, we will inform you immediately about the unavailability and immediately refund any payments that you might have made already.

§ 5 Prices and shipping costs

Our prices are retail prices in Euro. They include German VAT.
Information about shipping and handling fees is given with the respective product.
For orders from outside Germany additional fees or customs may apply at the country of destination.  Such costs shall be borne by the Buyer, as we have no control on these charges and their amount.

§ 6 Payment and Delivery

Unless otherwise agreed, delivery is from the respective warehouse to the delivery address specified by the purchaser. By handing over the goods to the delivery company, the risk of delivery passes to the buyer. Upon delivery against invoice, payment of the price is due within 30 days of invoicing and without deduction. Payments can be made ​​by bank wire transfer or by credit card (Visa or MasterCard). The Vendor reserves the right to supply in individual cases only against cash in advance. International orders are generally accepted only on payment by credit card (Visa, MasterCard, JCB) or bank wire transfer. Delivery time varies depending on the shipping method and the country to which the goods are sent.

§ 7 Offsetting, Retention

A right to offset by the Buyer is only established, if his claims are legally binding recognized - or recognized by the Vendor. In addition, retention may only be exercised, if his counterclaim is based on the same contract.

§ 8 Retention of title

Goods remain property of Vendor, until full payment of the price is received from the Buyer.

§ 9 Warranty

In case of any defect of the goods, the warranty regulations of German Civil Law - §§ 434 ff. BGB - apply.

§ 10 Data Protection

We use your personal data exclusively for purposes related to your order, such as for information about your order status and / or delivery status, authentication and access control, and internal customer analysis. Personal data will be treated confidentially and not disclosed to third parties.
The Customer explicitly consents with the collection, processing and use of the data obtained in connection with the business relationship.
The customer has a right of information and a right to have his data corrected, blocked or deleted.

§ 11 Governing law and legal venue

Contracts are governed by the law of the Federal Republic of German. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
If the customer is an enterprise or a legal entity under public law, the legal venue for any disputes arising from the contract is Berlin.
